Teva Pharmaceutical Industries Ltd.

The BCLP team defended a transnational pharma company in a dispute with a major Russian insurer over recovery of insurance compensation. The claims were based on a commercial loan insurance agreement obligating the insurer to reimburse the insured’s losses arising from its counterparties delaying payments under supply contracts.

The defendant refused to pay out the insurance compensation, arguing termination of coverage after delay by the counterparty beyond the maximum period permitted under the insurance agreement. Yet the insurer renewed the policy even though it was aware of the delay.  

BCLP lawyers presented a consistent position arguing the insurer’s bad faith and inconsistent conduct and that the agreement terms were to be interpreted in the insured’s favour.

This case might be of interest for interpreting insurance agreement terms relating to termination of coverage and for assessing insurers’ professional actions. The matter is of special significance for insurance of large-scale supplies of medicines.

Teva Pharmaceutical Industries

Representing the client in bankruptcy proceedings of its debtor, a big pharmaceutical company. The bankruptcy proceedings are complicated by supposedly insufficient assets disposed of to the debtor’s affiliates and the need to seek out the debtor’s assets. The bankruptcy is also complicated by a multiplicity of creditors (including several well-known bank pledgeholders).

Abbott Laboratories

Developed a cooperation model between Abbott Laboratories and pharmacy chains to encourage the latter to promote pharmaceutical products and purchase bigger volumes of products when bought from independent distributors rather than directly from manufacturers.


Successfully represented TEVA in labour disputes over accrual and payment of regional coefficients and percentage allowance over and above employee salaries in 3 regions (northern hardship bonus payment).

Bio-Rad Laboratories

The client requested our assistance in separation with an employee who consistently breached labour discipline. Our involvement included clearance of the disciplinary actions that had already been imposed on the employee by the client’s HR, assistance in holding the employee disciplinarily liable for further misconduct, facilitation of the employee’s dismissal and subsequent litigation with the employee.


Acting for Sanofi, won a series of customs classification cases heard by the Federal Arbitrazh (Commercial Court) for the Central Circuit, despite negative customs practice and case history on classification of similar goods elsewhere in Russia. The amount in dispute was over RUB 100 m per annum.

A major German pharmaceutical company

Our lawyers represented the interests of a major German pharmaceutical company in a series of patent disputes relating to the client’s inventions initiated under statements of claim filed by companies producing generic medications.

Bio-Rad Laboratories

Defended the position of Bio-Rad Laboratories, a big medical device and medicament producer and supplier, thereby depriving a distributor of the possibility of continuing to use its exclusive status for distributing the goods in the Russian Federation. In addition, as a result of the successful judicial work, the debtor was convinced to conclude an amicable agreement to repay a debt of over RUB 52 m to our client.

Advised Johnson & Johnson’s medical devices division on competition law compliance and trade terms development.

NPK Katren

Advised NPK Katren on matters involving anti-bribery policies and a range of antitrust matters, including compliance requirements, supply and shortage of goods, etc.

Danone, Guardian Industries, Kimberly-Clark and many others

Provided comprehensive legal support to Nissan Motor, Danone, Guardian Industries, Kimberly-Clark, Kronospan, Lafarge, Magna Automotive, Mars, Oriflame, TEVA Pharmaceutical, Efes Brewery and many others for various Greenfield industrial development projects in different regions. Matters advised on included acquisition of land plots for development, forest and farm land re-zoning, liaisons with authorities, public procedures, regulatory issues and licences, design and construction, environmental, project financing, infrastructure and utilities, litigation and legislative work in the federal, regional and municipal parliaments.

Alvansa Ltd, OBL Pharm’s management

Advised on a RUB 15.5 bn (approx. USD 240 m) investment sale of a controlling stake in Obolenskoe Pharm, a leading Russian pharmaceutical company. The stake was acquired by Sistema (LSE: SSA, MOEX: AFKS), a large Russian diversified holding company, jointly with VTB Bank from Alvansa Ltd, a holding company controlled by Gazprombank and UFG Private Equity. We represented the sellers in the main sale of the business and acted for OBL Pharm’s management team in its negotiations with investors with respect to the shareholder deal.
