Goltsblat BLP and the Pepeliaev Group reach an amicable settlement of their dispute over the rights to the name "Goltsblat" and use of the goltsblat.ru domain name.
On 28 September 2010, at a session of the Moscow Arbitration Court, Goltsblat BLP withdrew its lawsuit against the Pepeliaev Group over violation of its rights to the name “Goltsblat” and use of the goltsblat.ru domain name owing to an amicable settlement reached between the parties. The lawsuit was withdrawn after the Pepeliaev Group transferred all rights to the goltsblat.ru domain to Goltsblat BLP on 27 September 2010. The court successfully accepted abandonment of the claim and advised that the relevant ruling would be prepared in a week.
Goltsblat BLP brought a lawsuit against the Pepeliaev Group at the Moscow Arbitration Court on 6 July 2010. The essence of the lawsuit is violation of Goltsblat BLP’s rights to the name Goltsblat and Goltsblat BLP’s claim for prohibition of use of the goltsblat.ru domain by the Pepeliaev Group, which, after it changed its name from Pepeliaev, Goltsblat and Partners to Pepeliaev Group and ceased using the surname of its former partner Andrey Goltsblat in its company name, as of the date of the lawsuit was still using the domain name: when www.goltsblat.ru was typed into a browser, users were directed to the website of the Pepeliaev Group.
Goltsblat BLP perceived the Pepeliaev Group’s use of the domain name as unfair competition and a violation of Goltsblat BLP’s rights to the name “Goltsblat” and sought judicial protection of its rights.
On 7 July 2010, the court prohibited OOO Pepeliaev Group from making any use of the goltsblat.ru domain, including transferring rights to the domain name to any third parties, until the effective date of a relevant resolution by the Arbitration Court.
During the preliminary hearing on 11 August 2010, a representative of the Pepeliaev Group declared that the company had ceased using the www.goltsblat.ru web address for promoting its services and redirecting users to the Pepeliaev Group website and proposed to settle the dispute amicably, offering that Goltsblat BLP buy the domain name for 10,000 roubles.
On 22 September 2010, at a session of the Moscow Arbitration Court, representatives of Goltsblat BLP and the Pepeliaev Group confirmed that the dispute between the firms had been settled amicably and that they had signed an agreement on transfer of the rights to the goltsblat.ru domain to Goltsblat BLP on 21 September 2010.
In this context, the court ordered a recess in the court session until 28 September 2010 in order to give the Parties time to discharge their obligations under the agreement.
