Summer 2018: Civil, Land and Town-planning Legislation Changes Significantly

Bryan Cave Leighton Paisner (Russia) LLP advises that four federal laws have been enacted, changing significantly the civil, land and town-planning regulatory framework. These are:

  • Federal Law No. 339-FZ of 3 August 2018 “On Amending Part 1 of the Civil Code of the Russian Federation and Article 22 of the Federal Law “On Enacting Part 1 of the Civil Code of the Russian Federation”;
  • Federal Law No. 340-FZ of 3 August 2018 “On Amending the Town-planning Code and Certain Legislative Acts of the Russian Federation”;
  • Federal Law No. 341-FZ of 3 August 2018 “On Amending the Land Code and Certain Legislative Acts of the Russian Federation to Facilitate Siting of Linear Facilities”; and
  • Federal Law No. 342-FZ of 3 August 2018 “On Amending the Town-planning Code and Certain Legislative Acts of the Russian Federation”.

These federal laws are closely linked, while their core scope might be conventionally divided into four conceptual areas:

  • introducing a new public easement concept for siting utility works;
  • regulating in detail how special use zones are to be established;
  • regulatory changes in relation to unauthorised structures, and
  • changes in construction permission documentation.

Given the total volume of the above legislation (several hundred pages), we will issue four legal updates covering the new developments, to be circulated on a weekly basis.
