Fee introduced for use of federal public highways by vehicles weighing over 12 tonnes

Goltsblat BLP advises that, on 15 November 2015, new Article 31.1 of Federal Law No. 257-FZ dated 08 November 2007 "On Highways and Road Activities in Russia and Amendments to Certain Legislative Acts of the Russian Federation" (hereinafter the "Law") comes into effect, establishing that vehicles with a maximum permitted weight of over 12 tonnes are allowed to use federal public highways if a fee is paid to compensate for the damage they cause to the highways.

Currently, pursuant to Russian Government Resolution No. 504 dated 14 June 2013, this fee amounts to RUB 3.73 per kilometre.

On 15 November 2015, Article 12.21.3 of the Russian Code of Administrative Offences also comes into force. This stipulates administrative liability in the form of a fine for failure to comply with the legislation on paying a fee to compensate for damage: for drivers – RUB 5 000, for traffic officials – RUB 40 000, for individual entrepreneurs – RUB 40 000 and for legal entities – RUB 450 000. A repeat violation entails a fine for officials and individual entrepreneurs of RUB 50 000 and for legal entities – RUB 1 000 000.
