Clarifications from the Supreme Court on application of provisions in Section I, Part 1 of the Russian Civil Code: Procedural laws

Goltsblat BLP comments further on Resolution No. 25 of the Plenum of the Supreme Court of the Russian Federation “On Application by the Courts of Certain Provisions in Section I, Part 1 of the Civil Code of the Russian Federation” (the “Resolution”).

Although the Resolution focuses primarily on interpreting the rules of substantive law contained in the dramatically changed first part of the Russian Civil Code, the Supreme Court's Plenum has, in fact, clarified a whole range of procedural issues relating to civil rights protection tools available in certain situations. More importantly, the Resolution provides a basic framework for further unifying commercial and civil procedural laws, contains a number of novel, conceptually important developments and emphasises the significance of theoretical constructs set forth earlier.
