Construction of linear facilities of state and municipal significance: developments in the legislation

Goltsblat BLP advises that Federal Law dated 23 July 2013 No. 247-FZ "On Amending Article 70.1 of the Land Code of the Russian Federation and the Town Planning Code of the Russian Federation" (the "Law") has been adopted. In particular, the Law:

1) extends and specifies the list of cases in which land may be reserved for up to 20 years (the general rule is 7 years). Only construction of highways, railways and other linear facilities was listed as such before the Law’s effective date. Now these include construction and reconstruction of the following:

  • marine, internal water, railway and air transport facilities (including air transport facilities covered by the unified air traffic management system);
  • marine, internal water, railway and air transport facilities (including air transport facilities covered by the unified air traffic management system);
  • federal, regional, intermunicipal and local highways and other linear facilities of state or municipal significance.

2) specifies the requirements on territory development documents for territories being prepared for accommodating transport infrastructure linear facilities of federal, regional or local significance. For instance, these documents must be consistent with the engineering survey results.

The Law took effect on 24 July 2013.
