Approval of the Russian Territorial Planning Scheme in the Sphere of Transport

Goltsblat BLP advises that approval has been given to the Territorial Planning Scheme of the Russian Federation in the Sphere of Federal Transport (railway, air, marine and internal water transport) and the Federal Highways (Resolution of the Russian Government No. 384-r of 19 March 2013).

The Scheme lists types, names and purposes of the federally significant facilities intended for siting, their key features and their locations. The Scheme provides for two stages, the first until 2020 and the second until 2030. The document consists of text and graphical sections, the latter is available from the Federal State Information System of Territorial Planning at http://fgis.minregion.ru/fgis/.

The Scheme in particular allows for the identification of such properties as the Central Ring Road or the Moscow–Saint Petersburg Motorway (M-11) to be constructed. It should be noted that the Scheme indicates only the approximate locations (the so-called ’corridors’) of transport facilities. These will be clarified in the territorial planning documents.

Please also note that if the Scheme is approved, the state authorities will have legal grounds for making decisions on land reservation, seizure (including by purchase) of land plots for state or municipal needs, re-categorisation of land plots and the provision of state or municipally-owned land for the location of relevant federally significant facilities (part 4, article 9 of the Russian Town Planning Code).

Furthermore, it is anticipated that the Russian Territorial Planning Scheme in the Sphere of Pipeline Transport will shortly be approved by the Russian Government.
