Hazardous Production Facilities: State Register Temporary Maintenance Procedure

Goltsblat BLP advises a Temporary Procedure for Maintaining the State Register of Hazardous Production Facilities has been enacted (Order No. 31-rp of Rostekhnadzor dated 19 March 2013) (the “Procedure”).

The Procedure specifies Rostekhnadzor's administrative processes for recording hazardous production facilities in the Register in connection with enactment of Federal Law No. 22-FZ dated 4 March 2013, which impacts significantly on industrial safety regulation1. As you might recall, hazardous production facilities registered before 15 March 2013 must be re-registered and assigned a hazard class by 1 January 2014.

The operator of a hazardous production facility files a relevant application (for registration or re-registration), accompanied by the following documents:

  • a hazardous production facility registration card specifying its hazard class (the sheet template and recommendations on how it is to be filled out are attached to the Procedure);
  • information specific to the hazardous production facility;
  • original or duplicate of an earlier certificate of registration of hazardous production facilities; registration cards;
  • hazardous production facility safety justification (if required by law)

When registering hazardous production facilities in the Register, the registration authority is to ensure that the specific hazard class indicated by the applicant is justifiably assigned.

If a hazardous production facility is to be re-registered, its registration number remains the same unless the registration authority itself changes (in which case, the facility is assigned a new number).
