Goltsblat BLP announces more changes to the rules on state registration of real estate leases

Goltsblat BLP advises that, on 4 March 2013, previously adopted amendments to the Civil Code of the Russian Federation abolishing the need for state registration of real estate leases were cancelled (Federal Law of 4 March 2013 No. 21-FZ “On Amendment of Certain Legislative Acts of the Russian Federation and Invalidation of the Provisions of Legislative Acts of the Russian Federation”).

Real estate leases concluded for at least one year still have to undergo state registration and those for less than one year or for an indefinite term still do not need to be registered.

Let us recall that Federal Law of 30 December 2012 No. 302-FZ "On Amendment of Chapters 1, 2, 3 and 4 of Part One of the Civil Code of the Russian Federation” introduced amendments into the Civil Code envisaging cancellation, from 1 March 2013, of the need for state registration of the following types of agreement:

  • Real estate lease (including of buildings and structures, as well as enterprises);
  • Gift of real estate;
  • Sale of a house, apartment, part of a residential building or apartment;
  • Sale of an enterprise;
  • Rent contract for alienation of property on payment of rent.

Please note that the Federal Law of 4 March 2013 cancels the previously adopted amendments in relation to real estate leases, whereas the other innovations remain in effect.
