Possible changes to the land and town-planning legislation this autumn

Goltsblat BLP advises that various draft federal laws are likely to be considered during the autumn session of the State Duma of the Federal Assembly of the Russian Federation, which is due to start:

  • On Amendment of Parts One, Two, Three and Four of the Civil Code of the Russian Federation (the “New” Civil Code of the Russian Federation), which changes substantially, in particular, the entire system of real estate rights;
  • On Amendment of the Land Code of the Russian Federation and Certain Legislative Acts of the Russian Federation Changing the Conditions and Procedures for Allocating Land Plots out of Public Land;
  • On Amendment of the Land Code of the Russian Federation and Certain Legislative Acts of the Russian Federation Abolishing the Principle of Division of Land into Categories;
  • On Amendment of Certain Legislative Acts of the Russian Federation Improving the Procedure for Withdrawing Land Plots for State and Municipal Needs.

Express consideration and adoption of these draft laws are envisaged not only by the Tentative Programme of Legislative Work of the lower chamber of the Russian parliament (appendix to Resolution of the State Duma of the Federal Chamber of the Russian Federation dated 11 September 2012 No. 730-6 GD), but also the Action Plan (Road Map) “Improvement of the Business Climate in Construction” (approved by Resolution of the Government of the Russian Federation sated 16 August 2012 1487-r).

The given Road Map names several other draft laws that are expected to be introduced to the Government of the Russian Federation in the autumn:

  • A draft law envisaging introduction of rules requiring developers to create a transport, social and utility infrastructure;
  • A draft law envisaging additional consequences of absence (non adoption) of documents on territorial planning of the Russian Federation and constituent entities of the Russian Federation.
