Goltsblat BLP advises that Federal Law No. 289-FZ of 21 October 2011 “On Amendments to the Federal Law on the Procedure for Publishing and Enacting Federal Constitutional Laws, Federal Laws, and Acts of Chambers of the Federal Assembly” (the Federal Law) came into effect on 10 November 2011.
Initial publication of of the full text of a federal constitutional law, a federal law or an act of the Federal Assembly in Parlamentskaya Gazeta, Rossiyskaya Gazeta or the Collected Legislation of the Russian Federation is currently deemed its official publication.
Pursuant to the Federal Law, initial placement (publication) of the above on the “Official Internet Portal of Legal Information” (www.pravo.gov.ru) is also to be deemed official publication.
It is also stated that decrees and orders of the President of the Russian Federation are published on this Internal portal.
Moreover, legal acts of the Government of the Russian Federation, other Russian government authorities, laws and other legals acts of constituent entities of the Russian Federation and municipal legal acts are published on this Internet portal as determined by the President of the Russian Federation.
Please note that the Federal Law does not indicate that publication of decrees and orders of the President of the Russian Federation, legal acts of the Government of the Russian Federation, other Russian government authorities, laws and other legals acts of constituent entities of the Russian Federation and municipal legal acts on this Internet portal is to be deemed official publication of them. Acts of the President of the Russian Federation, acts of the Government of the Russian Federation and regulatory acts of federal executive bodies distributed in machine-readable format by the research and development centre of legal information System have, so far, also been deemed official.
The functioning of the state legal information system, including web publishing (mass media) “Official Internet Portal of Legal Information” (www.pravo.gov.ru), will be ensured by the Federal Guard Service of the Russian Federation (the FGS of Russia - 9, The Kremlin, Moscow 103986).
Relevant legal acts are already available on the Internet portal. Unfortunately, they are published only in html and txt formats (even not in rtf or doc) and are not available in a graphic format, so the acts are displayed, in particular, with distortions (for example, the number of new article 91 introduced by the Federal Law in question is incorrectly displayed as 9-1).
It is to be hoped that, when the Federal Law enters into force, identity of the texts of published legal acts to their originals will be ensured (for example, by also publishing them in a graphic format). It would also be helpful if the period of almost a week that elapses from the signing date of a legal act until it is published on the Internet portal were to be reduced.
