New Statutory Document Submission Procedure (One Stop Shop).

Goltsblat BLP advises that Federal Law 169-FZ “On Amendments to Certain Legislative Acts of the Russian Federation” (the “Law”) was adopted on 1 July 2011.
The Law was formally published in Rossiyskaya Gazeta on 4 July 2011 but entered into force on 1 July 2001 (except for certain provisions with different effective dates).
It amends more than 70 Russian laws, particularly the Federal Law “On State Registration of Legal Entities and Individual Entrepreneurs” and the Federal Law “On Provision of State and Municipal Services”.
The amendments are designed to incorporate the one-stop-shop principle in the Russian legislation governing submission of documents for issue, formalisation, re-issue or termination of approvals, licences, permits and registration documents. The idea is that state and municipal authorities will request and obtain any requisite documents from one another bypassing the applicants.
While making life easier for applicants, the Law does not free them entirely from the need to collect and prepare documents.
Consequently, we recommend that, for the purposes of your daily operations, you check on the updated procedures for document preparation, submission and issue in relevant laws.
Please also note that, in certain instances, the lists of relevant documents have been modified or restated, which might also affect your practices.
Possible implications of these changes are illustrated by the following. According to the amendments to the Federal Law “On Foreign Investment in Business Entities of Strategic Importance for National Defence and State Security”, if a Russian applicant fails to attach a document from the Companies’ (Individual Entrepreneurs’) Register to its application for preliminary clearance of a transaction by the competent authority (the Russian Anti-monopoly Service), the latter will obtain the relevant information by submitting an inter-agency request to the federal executive authority in charge of registration of legal entities and individual entrepreneurs (i.e., the Federal Tax Service).
Regulations previously passed by the Russian President, Russian Government and federal executive bodies are to be aligned with the Law by 30 September 2011. This means that the procedures, rules and lists of documents in these regulations will be modified substantially in accordance with the Law.
