Changes in the procedure for obtaining town-planning plans of land plots in Moscow.

Legal Update No. 273. 

Goltsblat BLP advises that Moscow City Law No. 27 dated 08 June 2011 “On Amendments to Moscow City Law No. 28 dated 25 June 2008 ‘Town Planning Code of the City of Moscow’” highlights the following provisions:

  • abolition of the provisional use/development rules (Clause 38 of the Town Planning Code of the City of Moscow).
  • invalidation of the provision of the Moscow Town Planning Code stipulating development of town-planning plans as part of land draft surveys if these land plots are intended for legal entities/individuals and construction purposes (Section 7, Clause 38 of the Town Planning Code of the City of Moscow). This rule used to conflict with the Russian Federation Town Planning Code.
  • invalidation of the provision of the Moscow Town Planning Code binding the relevant Moscow executive authorities to develop draft surveys or town-planning verifications in cases when no draft surveys have been issued for land plots of interest to applicants (Section 6, Clause 43 of the Town Planning Code of the City of Moscow). At the same time, the Moscow Town Planning Code still contains a rule allowing urban development and architecture authorities to decide on preparation of materials for verifying facility location (town-planning verification). 
  • elimination of the prerequisite for town-planning plans to be approved by some public Moscow City authorities, for instance, executive environmental surveillance or cultural heritage authorities, etc.

The Law came into effect on 16 July 2011.
