Amended Draft Law on Healthcare Fundamentals in the Russian Federation.

Goltsblat BLP advises that, on 1 December 2010, the Russian Ministry for Healthcare and Social Development published an amended draft Federal Law “On the Fundamentals of Public Health Protection in the Russian Federation” on its web-site at http://www.minzdravsoc.ru/.

The initial version of this draft law was posted on 30 July 2010.

The modified law contains amendments that in our opinion, may influence the development and operating strategies of pharmaceutical (medical) companies.

For example, amendments have been made to Article 34 ‘Medical Procedures’. Pursuant to Sub-clause 3, Part 5, Article 34, standard medical aid may include, inter alia, use of a minimum list of pharmaceuticals included, as per the medical aid standards, on the list of essential drugs, with an indication of their daily and course doses.

It is thus determined that the pharmaceuticals contained in the medical aid standards form the essential drug list. 

In addition, Article 34 introduces the notion of ‘treatment protocol’, which, alongside the Medical Procedures and Medical Aid Standards, becomes binding on all medical care providers within the Russian Federation.

Article 70 ‘Restrictions Applying to Medical and Pharmaceutical Personnel for the Purpose of their Professional Practice’ remain, however, unaffected.

Another significant amendment pertains to the effective date of the Law, which, under the new version, will take effect on 1 January 2012, save for certain provisions.
