No. 76. Russian Government: the “moratorium” on transactions with real estate belonging to federal state unitary enterprises (FGUP) is lifred
Goltsblat BLP advises that the Government of the Russian Federation has, by its resolution of 19 August 2009 No. 665, amended Resolution of 3 April 2008 No. 234 “On provision for housing and other construction on federally-owned land plots”. Federal executive authorities are now permitted to agree transactions to lease out federally-owned buildings (premises therein), structures and edifices held by FGUPs by right of economic management and located on land plots situated within population centres or within:
30 Km of the boundaries of population centres with a population of over 1 million;
15 Km of the boundaries of population centres with a population of up to 1 million;
5 Km of the boundaries of population centres with a population of up to 100 thousand.
Even so, the full “moratorium” on disposal of federally-owned land plots remains in force until 1 January 2010. Preliminary indications are that this “moratorium” will be extended for another 2 years.
