LEGAL UPDATE No. 7.

Goltsblat BLP advises that Federal Law No.FZ-7 “On Amendments to Article 225 of the Civil Code and Chapter 33 of the Civil Procedure Code of the Russian Federation” (hereinafter – the “Law”) was adopted on 9 February 2009.

The Law stipulates that ownership of unowned real estate claimed by the Federal Cities of Moscow and St. Petersburg may be recognised through the courts. Previously, only the right of municipal ownership of unowned real estate registered by the state registrar for real estate rights could be recognised in this manner.

Recognition of ownership by the Federal City of Moscow or St. Petersburg of unowned real estate located within the given city may be requested by competent authorities in charge of property owned by Moscow or St. Petersburg.

The amendments also specify that unowned real estate located within the Federal Cities of Moscow or St. Petersburg is to be registered by the state registrar for real estate rights on the basis of an application submitted by competent government authorities of the given cities.

The Law came into force on 20 February 2009.
