Placement of outdoor advertising on apartment blocks is regulated.

Goltsblat BLP advises that Federal Law No. 228-FZ On Amending the Housing Code of the Russian Federation” and Article 19 of the Federal Law “On Advertising” (the “Federal Law”) was adopted on 27 September 2009 and came into effect on 29 September 2009.

The Federal Law introduces specific rules for placing outdoor advertising on apartment blocks.

An addition to article 10 of the Federal Law “On Advertising” stipulates that contracts for installation and operation of advertising structures involving use of common property belonging to owners of premises in apartment blocks (the “owners”) may only be concluded subject to their consent.

As per the amendments to the Housing Code of the Russian Federation, the power to issue such a consent is vested in the general meeting of owners (the “General Meeting’), which is also entitled to authorise someone to conclude, on behalf of the owners, contracts for installation and operation of advertising structures on the terms it specifies.

Under the new rules, it is also impossible to obtain an advertising structure installation permit from the local authorities without the consent of the owners, since an application for such a permit must now contain Minutes of the General Meeting granting the relevant consent.
We recommend, therefore, that the above specifics be taken into account in decision-making on placing outdoor advertising on buildings for all types of goods, works and services.
