No. 78. Fire safety declarations to be submitted by 30 April 2010


Goltsblat BLP advises that Federal law of 22 July 2008 No. 123-FZ “Technical Regulations on Fire Safety Requirements” came into effect on 30 April 2009 with respect to industrial facilities, hazardous production factilities, construction sites and places of mass public gatherings.

According to the Regulations, in order to reduce the fire risk and for the purpose of assessing the potential loss to third parties, a fire safety declaration is drawn up with respect to capital construction facilities for which the legislation envisages state expert examination of the design documentation, as well as certain specialised facilities for protection.

The declaration is prepared by the developer or the person responsible for compiling the design documentation. For designed facilities requiring protection, the declaration is submitted before start-up.

For those already in operation as of 30 April 2009, the first safety declaration is to be submitted before 30 April 2010.

The declaration is executed in a set format, signed by the owner or person possessing the given facility by other lawful right and is submitted to the territorial department of the Ministry of Emergencies responsible for organisation and implementation of state fire supervision.

The Regulations also determine the system for fire prevention, identification and extinguishing, protection systems and fire hazard classes of buildings.
